COMPETITION RULES

1. This Promotional Competition (“Competition”) is organised by African Sales Company (Pty) Ltd (“Promoter”).
2. The Competition is open to permanent residents and citizens of South Africa over the age of 18 (eighteen) years in possession of a valid South African Identity Document except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls, or is controlled by, the Promoter and/or immediate family members of any employee, director, member, partner, agent or consultant of or person indirectly or directly in control or controlled by the Promoter, their agencies, advisers, dealers, suppliers, its affiliates and/or associated companies (“Disqualified Persons”).
3. The Competition is only valid within South Africa.  Participants must be within South Africa at the time of entering the Competition, for the verification process and at the time of the prizes being awarded should they be declared a winner, failing which such person will be disqualified and the draw of a replacement entry shall take place under the same terms and conditions as the first draw.
4. By entering the Competition, all participants and winners agree to be bound by these rules which will be interpreted by the Promoter, whose decision regarding any dispute will be final and binding and no correspondence shall be entered into regarding the decision.  The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this Competition and any prizes, or any aspect thereof, without notice at any time, for any reason that the Promoter reasonably deems necessary.
5. The Competition commences on 1 November 2017 and ends on 31 December 2017, both days inclusive.
6. The prize items (“Prizes”) available to be won include:
a. 1000 x R10 instant airtime rewards
b. 30 Paco Rabanne prize hampers
c. 1 x R1 million cash prize (“Grand Prize”)
7. The Prizes are neither transferable nor the hampers redeemable for cash and the Promoter is not liable for any defect in the Prizes.  The Promoter reserve the right to substitute Prizes with any other prize of comparable commercial value.
8. Prize images on the POS material are used to represent the prizes for promotional purposes, and might differ from the actual prizes awarded

ENTRY

a. To stand a chance of winning one of the Prizes, participants must purchase any Paco Rabanne product and follow the prompts on the entry line *120*7226#
b. Entries that are unclear, are submitted via an incorrect entry mechanism or contain errors or are from Disqualified Persons will be declared invalid.
c. Participants must enter on a phone that is owned and registered to that person. No other person can use another person’s phone for Competition entry purposes. If it is discovered that participants have entered on a phone that is not registered to them they will be disqualified and the entrant will be requested to refund the prizes to promoter. This is to avoid fraud and ensure compliance to the Consumer Protection Act 68 of 2008. Each entrant is expected to be the owner of that phone and no singular person can enter off another mobile phone number. This is to avoid additional fraud being conducted by multiple SIM card owners.
d. Participants may enter the Competition as many times as they wish over the Competition period, provided that participants complete the Competition entry steps set out in Rule 9a above. Participants stand a chance of winning one merchandise prize only. Entrants drawn twice will forfeit the second hamper. Airtime and hamper winners will still be eligible to win the R1 million cash prize.

WINNER SELECTION AND CONTACTING

a. All winners (instant winners, hampers and Grand Prize) will be determined by random selection.
b. The Promoter will conduct a random draw on Monday 15 January 2018 (“Grand Prize Draw Date”) for the Grand Prize from all the entries received within the Competition period.
c. The Promoter will call the possible winners on the number they used to enter to conduct a Competition verification process, which may include verification of the finalist’s particulars and confirmation of purchase. The possible winner will be called once a day for 3 (three) days and if the Promoter is not able to contact the possible winner during this time, the Promoter will move onto the next possible winner.
d. If the Promoter is unable to reach any person or complete the verification process after drawing a possible winner’s entry for whatsoever reason, such person will be disqualified and the selection of a replacement entry shall take place under the same terms and conditions as the first draw.
e. Proof of purchase will be required with the verification documentation. The purchase must have taken place between 1 November 2017 and 31 December 2017 and must be for a legitimate Paco Rabanne product from an Authourised Distributor. Proof of purchase for the hamper prizes distributed within the campaign period must be dated before the date of contact by the Promoter.
f. Potential prize winner is not an actual winner until his / her submission is validated and his / her documents are completed and submitted.
g. Participants whose entries have been drawn and have been confirmed as valid after the verification process, will be notified telephonically within 24 hours from receipt of valid documentation set out in rule 10c and declared a winner. The validity of such documentation is at the Promoter’s discretion.

PRIZE DELIVERY

a. Airtime will be instantly loaded onto the number used to enter the Competition.
b. The merchandise prizes will be couriered to the winner’s chosen address within the Republic of South Africa within 28 (twenty-eight) working days. Couriers will attempt to contact the winner 3 (three) times on the cellphone number provided by the winner to request daytime delivery details; failure to take these calls will constitute forfeiture of the prize. Couriers will attempt to deliver the merchandise prize at the nominated daytime delivery address; failure to be present to receive the delivery will constitute forfeiture of the prize and the prize will revert back to the Promoter.
c. The cash prize will be delivered to the winner through conventional banking channels only and will require full FICA documentation to be provided upfront.
3. Should any winner refuse or be unable to comply with any of these rules for any reason, such winner will be deemed to have rejected the Prizes and it shall revert back to the Promoter, who will select another potential winner.
12. The Promoter may require the winners to be identified and photographed and the photographs published in printed or social media, or to appear on radio and television, when accepting their Prizes and/or after having received their Prizes. The winners and/or their partners will be given the opportunity to decline to the publication of their images and to participate in the Promoters’ marketing material in so far as it relates to the Competition.
13. All participants and the winners, as the case may be, indemnify the Promoter, their advertising agencies, advisers, nominated agents, suppliers and Bottlers of beverages identified by the trademarks owned by or licensed to African Sales Company (Pty) Ltd, its affiliates and/or associated companies against any and all claims of any nature whatsoever arising out of and/or from their participation in any way howsoever in this competition including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoters and/or use of the Prizes.

INDEMNITY RULES

  1. The sponsor and fulfilment agent do not give any representation, warranties or guarantees in respect of the suitability of the product. The customer warrants that he/she acquaints themselves fully with the product and that he/she did not make any decisions solely reliant upon any professional advice or representation from the sponsor or fulfillment agent. The customer confirmed that he/she has satisfied themselves in relation to all matters regarding the product. All promotional material, pictures, illustrations and descriptions are for illustration only and do not form part of the agreement.
  2. This agreement shall constitute the entire understanding between the parties and, as such, including this clause, may not be altered or modified except by an agreement in writing signed by all parties.
  3. The sponsor and fulfillment agent do not guarantee the safety standards or satisfactory performance of any supplier. Utilising of the prize products may be dependent on certain factors beyond the sponsor and fulfillment agent’s control and neither will not be held liable for the cancellation, postponement or price increases enforced by the supplier.
  4. The sponsor and fulfilment agent shall not be liable to the customer for the death, personal injury, direct and/or consequential damages or losses of any customer in respect of the product supplied by a third party supplier. The customer hereby agrees to defend, indemnify and hold harmless the sponsor and fulfillment agent against all suits, actions, claims, judgments, injury, direct and/ or consequential damages or losses or other liabilities, and all costs and expenses which may arise from the product or the omission of supplying the product by any third party supplier.

PUBLICITY RULES

  1. Publicity endeavours will be within legal and reasonable ethical confines, especially regarding usage of images of winners under the age of 18.
  2. The Promoter retains the right to use winners’ image, reviews and testimonials for publicity purposes for a two year period post the fulfilment of the prize. Thereafter, the sponsor must formally request permission for same from winner and approval is solely at the winner’s discretion. All publicity on winners under the age of 18 must be formal consent of their parent and/or guardian.
  3. By entering, participants give the promoter the right to retain their personal information for future promotional and marketing purposes.
