COMPETITION RULES

  1. The promotional competition is organised by Paco Rabanne South Africa, a division of African Sales Company, collectively known as the “Promoters”.
  2. The competition starts on 1 July 2016; ends on 31 July 2016 (both dates inclusive); winners will be drawn by 19 August 2016.
  3. Winners will be eligible for the competition prize, which includes a trip to Los Angeles for 2 people. Winners will be provided with a detailed description of all elements of the prize when contacted by the fulfilment agent.
  4. Judges’ decision is final and no correspondence will be entered into.
  5. Prizes are not exchangeable for cash.
  6. Entry is open to anyone except employees (and their immediate families), directors, members, partners, suppliers, retailers, staff, agents or consultants of Paco Rabanne, African Sales Company, suppliers of goods and services in connection with this competition or any person directly or indirectly controlled by the Promoters, their agencies, advisers, dealers and suppliers identified by the trademarks owned or licenced to Paco Rabanne or African Sales Company.
  7. This competition is only open to residents of the Republic of South Africa; winners will be required to present their SA ID book.
  8. Winners must be over the age of 18 and in possession of a valid passport.
  9. Entrants may enter via sms (45753). Standard SMS rates apply (costs R1,50 per message); or by taking a trip with Uber South Africa using the special Paco Rabanne Black XS promo code/view during the Uber and Paco Rabanne Black XS campaign period.
  10. This competition is only open to residents of the Republic of South Africa; winners will be required to present their SA ID book.
  11. By entering the promotional competition, all participants and winners agreed to be bound by these rules which will be interpreted by the Promoters, whose decision will be final and binding.
  12. Promoters reserve the right to amend, modify, change, postpone, suspend or cancel this competition and any prizes that have not yet been subject to draw, or any aspect thereof, without notice, for any reasons that the Promoters reasonably deem necessary.

MECHANICS

  1. Participants may enter the promotional competition as many times as they wish over the promotional period, provided that participants purchase the Participating Products each time and complete the Promotional Competition Entry by supplying the following information: product barcode, email and retaining original proof of purchase or by taking a trip with Uber South Africa using the special Paco Rabanne Black XS promo code/view during the Uber and Paco Rabanne Black XS campaign period.
    1. All entries from Disqualified participants’ cell phone numbers will be rejected;
    2. No computer based entries will be accepted;
    3. Any cell phone number that enters more than 3 (three) times within a 24 hours period will be locked out of the promotional competition for 1 (one) day (“Blocked Participants”);
  2. There are two ways to enter the competition:
    1. Purchase any Paco Rabanne Black XS fragrance during the month of July from Truworths and sms your barcode, together with your email address to 45753. Consumers must keep their original proof of purchase of their Paco Rabanne Black XS fragrance. Should they be selected as a winner, they will need to produce this in order to claim the competition prize.
    2. By taking a trip with Uber South Africa using the special Paco Rabanne Black XS promo code/view during the Uber and Paco Rabanne Black XS campaign period; you will automatically be entered into the draw.

PRIZES

  1. There is a total of one prize item to be won. The prize items (“the Prize”) is:
    1. A trip to Los Angeles for 2 people (including the winner). Only the following items are included in the prize: Flights for 2 people from OR Tambo International Airport to Los Angeles International Airport, 5 nights’ accommodation (Sharing basis) and total spending money of 1000 USD for two people only. All other expenses will need to be covered by the winners.
    2. Due to the random nature of the prize distribution and potential winners not claiming their prizes, it is possible that not all Prizes will be awarded or claimed.
    3. Winners will be required to complete and submit a winners form, as well as supply a copy of their valid ID and passport within 72 hours of being confirmed a winner, to enable the Promoter to ensure compliance with these rules and the Consumer Protection Act 68 of 2008. Should any winner refuse or be unable to comply with this rule for any reason, such winner will be deemed to have rejected the Prize and it shall revert back to the Promoter.
    4. One x R120,000 experience, amounting to a total prize pool of R120,000. Eligibility for travel prizes are outlined in the Fulfilment rules.
    5. The competition prize must be used before the end of 2016. Winners who do not use their prize before then will forfeit their prize.

FULFILMENT RULES

  1. Winner selection will be conducted in adherence to good audit practice.
  2. Winners will be contacted within 72 hours after the prize draw to co-ordinate redemption of their prize. Winners will be contacted up to 3 times by phone call and twice by sms, thereafter it is the winner’s responsibility to contact the fulfilment agent. Winners must contact fulfilment agent within 14 working days or forfeit the prize.
  3. Winners who do not claim their prize or provide the required documents within 14 working days will forfeit their prize.
  4. African Sales Company will handle the complete fulfilment of the prizes, including all travel arrangements for the winners.
  5. Where legally mandatory, winners must be eligible for the requisite visas. Most embassies require application in person, but winners will be advised and assisted through the process. Winners visa costs will be covered however winners will be liable for their own travel costs to and from the Embassy where required.
  6. The prize fulfilment dates will be agreed upon with the sponsor and the winner, giving the stipulated days notice as specified by the prize supplier (normally minimum 30 days, maximum 3 months).
  7. Some package timings (where stipulated) are not negotiable. Winners unable to travel on these dates forfeit the prize.
  8. Accommodation and other bookings may change from the advertised due to limits in availability. Winners will be notified with reasonable notice period.
  9. Winners will be responsible for travel to and from their ‘home’ airport to OR Tambo International unless stipulated.
  10. Once confirmed in writing, experience dates and names are not changeable.
  11. Winners are responsible for any additional expenses, including all incidentals not listed as part of the prize package.
  12. Itineraries are provided for convenience purposes only. It is the responsibility of the winner to confirm the dates and times with the travel documents and/or tickets and to familiarise themselves with the travel/experience plan, especially when date changes apply.
  13. Any amendment, change or cancellation by a winner to a reservation in whatsoever manner (date change, rerouting etc.) after full payment and issuing of travel documents; must be done in writing and will incur an administration fee charged by the fulfilment agent as well as the stipulated penalty of the supplier. This penalty could be up to 100% of the services price. Airline refunds will take a minimum of 12 (twelve) weeks to process.
  14. No refunds are available once the product has been utilised.

INDEMNITY RULES

  1. The sponsor and fulfilment agent do not give any representation, warranties or guarantees in respect of the suitability of the product. The customer warrants that he/she acquaints themselves fully with the product and that he/she did not make any decisions solely reliant upon any professional advice or representation from the sponsor or fulfillment agent. The customer confirmed that he/she has satisfied themselves in relation to all matters regarding the product. All promotional material, pictures, illustrations and descriptions are for illustration only and do not form part of the agreement.
  2. This agreement shall constitute the entire understanding between the parties and, as such, including this clause, may not be altered or modified except by an agreement in writing signed by all parties.
  3. The sponsor and fulfillment agent do not guarantee the safety standards or satisfactory performance of any supplier. Utilising of the prize products may be dependent on certain factors beyond the sponsor and fulfillment agent’s control and neither will not be held liable for the cancellation, postponement or price increases enforced by the supplier.
  4. The sponsor and fulfilment agent shall not be liable to the customer for the death, personal injury, direct and/or consequential damages or losses of any customer in respect of the product supplied by a third party supplier. The customer hereby agrees to defend, indemnify and hold harmless the sponsor and fulfillment agent against all suits, actions, claims, judgments, injury, direct and/ or consequential damages or losses or other liabilities, and all costs and expenses which may arise from the product or the omission of supplying the product by any third party supplier.
  5. Winners must ensure that they comply with any medical and vaccination requirements of the prize.

PUBLICITY RULES

  1. Publicity endeavours will be within legal and reasonable ethical confines, especially regarding usage of images of winners under the age of 18.
  2. The Promoter retains the right to use winners’ image, reviews and testimonials for publicity purposes for a two year period post the fulfilment of the prize. Thereafter, the promoter must formally request permission for same from winner and approval is solely at the winner’s discretion. All publicity on winners under the age of 18 must be formal consent of their parent and/or guardian.
  3. By entering, participants give the promoter the right to retain their personal information for future promotional and marketing purposes.
